Terms of Service

1. INTRODUCTION

Welcome to Supernova ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Supernova mobile application, web application, and related services (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

2. DESCRIPTION OF SERVICE

Supernova is a digital accountability platform that helps users build and maintain workout habits through:

• Personal accountability contracts setting workout frequency commitments
• AI-assisted attendance verification using submitted photos
• Streak tracking and progress statistics
• Social features including challenges and community engagement
• Optional subscription services for enhanced features

Supernova is NOT a fitness instruction service, medical advice platform, or guaranteed results program.

3. ELIGIBILITY AND ACCOUNT CREATION

3.1 Age Requirement

You must be at least 13 years old to use the Service. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have parental or guardian consent.

3.2 Account Creation

To access certain features, you must create an account by providing:

• Valid email address
• Username
• Password
• Timezone information

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

3.3 Account Termination

You may delete your account at any time through the settings menu. We reserve the right to suspend or terminate accounts that violate these Terms.

4. SERVICE FEATURES

4.1 Free Features

All users have access to:

• Personal accountability contracts
• Photo-based attendance verification
• Streak tracking and statistics
• Basic social features
• Free challenges

4.2 Subscription Features

A paid subscription ($5.99/month) unlocks:

• Access to premium paid challenges
• Unlimited challenge participation
• Enhanced community features

4.3 Accountability Contracts

Users may create personal accountability contracts by:

• Selecting workout frequency (days per week)
• Choosing scheduled workout days
• Setting optional skip days (grace periods)
• Authorizing a payment method for subscription billing

Important: Creating a contract does NOT result in immediate charges. Contracts include a 7-day free trial period. Subscription billing only begins if you join paid challenges or continue beyond the trial period.

5. ATTENDANCE VERIFICATION

5.1 Photo Submission

To verify workout attendance, users submit photos through the Service showing:

• A thumbs-up gesture
• Gym environment indicators (equipment, mirrors, facility features)
• GPS location data within reasonable proximity to workout facilities

5.2 AI-Assisted Verification

Submitted photos are processed using automated image analysis technology to detect:

• Presence of thumbs-up gesture
• Environmental indicators consistent with workout facilities
• Photo authenticity (preventing reuse of previous images)

5.3 Verification Results

• Verified: Photo meets requirements, attendance recorded, streak continues
• Rejected: Photo does not meet requirements, user may resubmit

5.4 GPS Verification

GPS data is collected to confirm proximity to workout facilities. GPS coordinates are:

• Used only for location verification
• Not shared with third parties
• Retained according to our Privacy Policy

6. STREAKS AND PROGRESS TRACKING

6.1 Streak Mechanics

Your "streak" represents consecutive days with verified workout proofs. Streaks:

• Increment by 1 for each verified proof submission
• Continue across gaps when you have no active contract
• Reset to 0 ONLY when you miss a scheduled contract day without available skip days
• Are preserved when you use a skip day

6.2 Skip Days

Skip days are grace periods that:

• Are allocated per challenge (not globally)
• Protect your streak when used on missed contract days
• Are automatically applied when available
• Do not roll over or accumulate beyond challenge parameters

6.3 Statistics

We track and display:

• Current streak (consecutive verified proofs)
• Longest streak (all-time record)
• Total check-ins (lifetime verified proofs)
• Days completed vs. days missed
• Challenge completion rates

7. CHALLENGES AND SOCIAL FEATURES

7.1 Challenge Types

• Personal: Individual accountability commitments
• Community: Shared public challenges
• Group: Private group challenges
• Social: Engagement-only (no attendance requirements)

7.2 Free vs. Paid Challenges

• Free challenges: Available to all users without subscription
• Paid challenges: Require active subscription (after 7-day trial)

7.3 First Paid Challenge Trial

Each user receives ONE free 7-day trial for their first paid challenge. After the trial is used, a subscription is required to join additional paid challenges.

8. USER-GENERATED CONTENT AND ZERO TOLERANCE POLICY

8.1 Prohibited Content

You are strictly prohibited from uploading, submitting, or sharing any content that contains or depicts:

• Nudity, pornography, or sexually explicit material
• Violence, gore, or graphic injury
• Hate speech, discrimination, or racist content
• Harassment, bullying, or threats against any individual or group
• Illegal activities or promotion of illegal behavior
• Self-harm or suicide-related content
• Child exploitation or endangerment
• Terrorism or extremist content
• Spam, malware, or malicious code
• Impersonation or identity theft
• Copyright or trademark infringement
• Any other content deemed objectionable, offensive, or inappropriate

8.2 Content Filtering and AI Moderation

All user-submitted content is subject to automated and manual review:

• AI-Powered Screening: Photos are analyzed using AI technology to detect prohibited content before acceptance
• Automatic Rejection: Content flagged as objectionable is automatically rejected and not stored
• Human Review: Flagged content may be reviewed by our moderation team
• Proactive Monitoring: We continuously monitor user-generated content for policy violations

8.3 Content Reporting Mechanism

If you encounter objectionable content or abusive behavior, you can report it immediately:

• In-App Reporting: Tap the "Report" button on any user profile or content
• Email Reporting: Send details to abuse@supernovahq.app
• Urgent Reports: For immediate safety concerns, contact safety@supernovahq.app

When reporting, please provide:

• Username of the offending user
• Description of the violation
• Screenshots or evidence (if applicable)
• Date and time of the incident

8.4 24-Hour Enforcement Commitment

8.5 Verification Fraud

You agree NOT to:

• Submit photos you did not personally take
• Reuse old photos or photos taken by others
• Manipulate GPS data or location information
• Use automated systems to generate fake proofs
• Share accounts to submit proofs on behalf of others

8.6 Abuse of Service

You agree NOT to:

• Create multiple accounts to exploit trial periods or evade bans
• Harass, bully, stalk, or threaten other users
• Post offensive, discriminatory, or inappropriate content
• Attempt to reverse-engineer or compromise our systems
• Use the Service for any illegal purpose
• Engage in any behavior that disrupts or harms the community

8.7 User Blocking

You have the ability to block any user whose behavior you find objectionable. Blocked users cannot view your profile, interact with your content, or contact you through the Service.

9. INTELLECTUAL PROPERTY

9.1 Supernova Property

We retain all rights to:

• The Supernova name, logo, and trademarks
• Software, algorithms, and AI verification technology
• User interface design and app functionality
• Documentation and marketing materials

9.2 Your Content

You retain ownership of photos and content you submit. By using the Service, you grant us a limited, non-exclusive license to:

• Process your photos for verification purposes
• Display your username and statistics in social features
• Use aggregate anonymized data for service improvement

We do NOT:

• Claim ownership of your photos
• Share your photos with third parties (except AI verification service providers)
• Use your photos for marketing without explicit consent

9.3 Feedback

If you provide suggestions or feedback, we may use them without obligation to you.

10. PRIVACY AND DATA USE

10.1 Data Collection

We collect:

• Account information (email, username, timezone)
• Workout data (proofs, GPS, verification results)
• Usage statistics (app interactions, feature usage)
• Payment information (processed by Stripe, Inc.)
• Device data (timezone, app version, platform)

10.2 AI Processing

Photos submitted for verification are transmitted to third-party AI service providers (OpenAI) for automated analysis. These services:

• Analyze photos for gesture detection and environment verification
• Do NOT perform facial recognition or biometric identification
• Process data according to their privacy policies
• Retain data according to their retention policies

10.3 Data Sharing

We do NOT sell your personal data. We share data only with:

• Payment processors (Stripe) for billing
• AI verification providers (OpenAI) for photo analysis
• Cloud infrastructure providers (Supabase, AWS) for hosting
• Analytics services for service improvement (aggregate data only)

10.4 Your Privacy Rights

You have the right to:

• Access your personal data
• Request deletion of your account and data
• Withdraw consent for data processing
• Export your data in machine-readable format
• Opt out of non-essential data collection

12. DISCLAIMERS AND LIMITATIONS OF LIABILITY

12.1 No Medical or Fitness Advice

THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL, FITNESS, OR HEALTH ADVICE.

• We are NOT healthcare providers
• We do NOT diagnose, treat, or prevent medical conditions
• We do NOT guarantee fitness results or health outcomes
• You should consult a physician before beginning any exercise program

12.2 Use At Your Own Risk

You acknowledge that:

• Exercise involves inherent risks of injury
• You are solely responsible for determining appropriate workout intensity
• You will listen to your body and stop if you experience pain or discomfort
• We are NOT liable for injuries sustained during workouts

12.3 Service Availability

We provide the Service on an "AS IS" and "AS AVAILABLE" basis. We do NOT guarantee:

• Uninterrupted or error-free service
• Accuracy of verification results
• Availability of features or content
• Compatibility with all devices or platforms

12.4 Third-Party Services

We integrate with third-party services (Stripe, OpenAI, Apple services). We are NOT responsible for:

• Third-party service failures or downtime
• Third-party data practices or security
• Changes to third-party pricing or terms

12.5 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are NOT liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Lost profits, data, or business opportunities
• Service interruptions or data loss
• Actions of other users
• Injuries sustained during exercise

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR $100 IF GREATER).

Some jurisdictions do not allow liability limitations, so these may not apply to you.

13. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Supernova, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of others
• Content you submit to the Service

14. DISPUTE RESOLUTION

14.1 Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

14.2 Informal Resolution

Before filing a claim, you agree to contact us at legal@supernovahq.app to attempt informal resolution.

14.3 Binding Arbitration

Any dispute not resolved informally within 30 days shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Arbitration terms:

• Individual basis only (no class actions)
• Location: Delaware or your state of residence
• Costs: Each party pays their own attorneys' fees unless the arbitrator awards fees to the prevailing party
• Exceptions: Either party may seek injunctive relief in court to protect intellectual property

14.4 Class Action Waiver

You agree to bring claims only on an individual basis. You waive any right to participate in class actions, class arbitrations, or representative proceedings.

14.5 Jury Trial Waiver

You waive the right to a jury trial in any proceeding related to these Terms.

15. MODIFICATIONS TO TERMS

We may modify these Terms at any time by:

• Posting updated Terms with a new "Last Updated" date
• Notifying you via email or in-app notice (for material changes)
• Providing 30 days' notice before changes take effect

Continued use after changes take effect constitutes acceptance of new Terms.

16. TERMINATION

16.1 By You

You may terminate your account at any time by:

• Accessing Settings > Account > Delete Account
• Following the account deletion prompts
• Confirming deletion via email verification

Upon deletion:

• Your active subscription will be cancelled (no refund for current period)
• Your account data will be deleted according to our retention policy
• You will lose access to all features and content

16.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or abusive behavior
• Required by law or legal process
• We discontinue the Service

We will provide notice when practical, except for immediate threats or legal requirements.

17. GENERAL PROVISIONS

17.1 Entire Agreement

These Terms, together with the Subscription Terms Addendum and Privacy Policy, constitute the entire agreement between you and Supernova.

17.2 Severability

If any provision is found unenforceable, the remaining provisions continue in full effect.

17.3 No Waiver

Our failure to enforce any right or provision is not a waiver of that right.

17.4 Assignment

You may not assign these Terms. We may assign our rights to any affiliate or successor.

17.5 Force Majeure

We are not liable for failures due to events beyond our reasonable control (natural disasters, wars, pandemics, infrastructure failures).

By using the Service, you acknowledge that:

• You have read and understand these Terms
• You have read and understand the Subscription Terms Addendum
• You have read and understand the Privacy Policy
• You agree to be bound by all provisions
• You understand and accept the Zero Tolerance Policy for objectionable content and abusive behavior
• You acknowledge that any violation of content policies will result in immediate and permanent account termination
• You agree to use the reporting mechanism to flag any objectionable content or abusive users
• You consent to AI-assisted verification of photos
• You understand this is NOT a medical or fitness advice service
• You understand missing scheduled days affects only streaks/statistics, NOT billing
• You exercise at your own risk
